Abstract

This article examines the right to higher education for the settlers of the agrarian reform. This human right is contextualized in the policy of affirmative action for access to higher education. It examines the cases of Universidade Federal de Goiás (UFG) and the University of Feira de Santana (UEFS), in Brazil, which created the Special Class of the course of law for the settlers of the agrarian reform. The legal basis of this affirmative action is Decree No. 7,352/2010, which established the national programme for education in agrarian reform (PRONERA) and the position of the Supreme Court (STF) on the constitutionality of affirmative action. However, the Federal Public Ministry of Goiás (MPF-GO) brought a public Civil action in which they demanded the extinction of such a course at UFG. Therefore, analyse the judicial discourse in screen, questioning the design of popular legal education as a human right.
