Constitutional Protection of the Right to Water: the Colombian Case

Abstract

This paper briefly examines the significance and recognition of the right to water at the international level. It then looks into the history of this right as it was promoted by the Constitutional Court of Colombia, understanding this process as a valuable
experience for the recognition of water as an authentic and actionable fundamental right, and with an aim to determine what its full enjoyment depends on, particularly in contexts where the precarious economic situation of an individual or a community prevents its fulfillment.

Abogado cum laude con opción en filosofía de la Universidad de los Andes, Colombia. Fue miembro investigador del programa de Justicia Global de la misma Universidad. Actualmente se desempeña como auxiliar judicial de la Corte Constitucional de Colombia y profesor asistente del Consultorio Jurídico de la Universidad de los Andes.
